Deposit & Reservation Policy
WYG Hawaiʻi LLC | Policy Version 2026-09-27
Effective: September 27, 2026, upon publication (Hawaiʻi time)
This policy applies only when WYG Hawaiʻi LLC expressly identifies a payment as a deposit, reservation payment, commission deposit, or custom-work deposit before payment is made.
A normal purchase of an available artwork is not automatically considered a deposit, reservation fee, studio-time fee, or commission payment.
When a Deposit May Apply
WYG may request a deposit for transactions involving circumstances such as:
- commissioned or custom artwork;
- personalized or made-to-order work;
- reserved artwork or inventory held for a specific collector;
- special materials, colors, dimensions, finishes, or fabrication requirements;
- extended design consultation or project development; or
- private allocations or other transactions governed by separate written terms.
Before a deposit is collected, WYG will identify the payment as a deposit and provide the material terms applicable to that transaction.
Purpose of a Deposit
A deposit may reserve artwork, materials, production capacity, design time, scheduling, or a collector allocation that would otherwise remain available to others.
Where applicable, a deposit may also reflect work already undertaken in connection with a commission or custom project, including consultation, design development, sourcing, preparation, or fabrication.
Application of Deposits
Unless different terms are agreed in writing before payment, a deposit will be applied toward the purchase price of the artwork or project for which it was collected.
A deposit does not create an ownership interest in an artwork until the applicable purchase requirements have been completed.
Refundability
Deposits are generally non-refundable once WYG has begun reserving inventory, allocating materials, performing design or consultation work, scheduling production, preparing the artwork, or otherwise relying upon the collector’s commitment, except where a refund or other remedy is required by applicable law or expressly agreed by WYG in writing.
Nothing in this policy eliminates any consumer right or remedy that cannot lawfully be waived.
If WYG cancels a project, is unable to perform the agreed work, or cannot fulfill the transaction, WYG will provide the refund or other remedy required by applicable law or the applicable written agreement.
Cancellations
A collector’s decision not to proceed with a commissioned, custom, personalized, reserved, or specially allocated transaction does not automatically create a right to reimbursement of a deposit.
Any cancellation will be evaluated according to:
- the written terms provided before payment;
- work already performed;
- materials or inventory already committed;
- the stage of production or preparation; and
- applicable law.
Gallery Credit
WYG may, at its discretion, approve the transfer of some or all of a deposit to gallery credit as a goodwill accommodation.
Gallery credit is not automatically created by cancellation and is not a standing entitlement.
Any gallery credit must be confirmed in writing and will state its amount, expiration date, permitted use, and any other applicable conditions.
Reserved Artwork
Artwork is not considered reserved solely because a collector has expressed interest in it.
When WYG agrees to reserve a work, the applicable reservation terms—including any required deposit, reservation period, remaining balance, and deadlines—will be provided in writing.
Failure to complete the transaction within an agreed reservation period may result in release of the artwork to other collectors, subject to the applicable written agreement and mandatory legal rights.
Commissions & Custom Work
Commissioned, personalized, and made-to-order projects may involve separate written terms covering:
- scope of work;
- design specifications;
- estimated completion time;
- deposit amount;
- payment schedule;
- revisions;
- materials;
- cancellation;
- delivery; and
- final acceptance.
Those specific written terms control where they differ from this general Deposit & Reservation Policy.
Production & Communication
Completion times for handcrafted artwork are estimates unless a specific deadline has been expressly guaranteed in writing.
Timing may be affected by design complexity, material availability, studio scheduling, curing or finishing requirements, shipping logistics, or other circumstances associated with handcrafted production.
WYG will make reasonable efforts to communicate material changes affecting a commissioned or reserved project.
Relationship to Other WYG Policies
This Deposit & Reservation Policy supplements WYG Hawaiʻi LLC’s Final Sale, Returns & Courtesy Credit Policy and Purchase Cancellation Policy.
For clarity:
A completed purchase of an available artwork is not automatically a deposit.
Deposit terms apply only when a payment has been specifically identified and disclosed as a deposit, reservation payment, commission deposit, or similar payment before the collector makes that payment.
Earlier transactions remain subject to the terms applicable when they were entered into and any mandatory legal rights.
