These Terms and Conditions govern access to and use of WYG.Glass, including purchases, services, registry functions, certification and authentication services, and other offerings made available by WYG Hawai‘i LLC.

By accessing this website, creating an account, submitting an order, purchasing a work, or otherwise using the services provided through this website, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

Age Eligibility

Purchases through WYG.Glass are restricted by WYG Hawai‘i LLC to persons 21 years of age or older.

By submitting an order, you represent that you are at least 21 years of age and legally capable of entering into a binding transaction.

WYG Hawai‘i LLC reserves the right to request reasonable age or identity verification before accepting or completing a transaction and may decline or cancel an order when satisfactory verification cannot be obtained.

This age requirement is a WYG Hawai‘i purchasing policy and does not alter the classification or intended purpose of the artworks offered through this website.

Nature and Intended Purpose of WYG Works

WYG Hawai‘i LLC creates and offers handmade collectible glass art, cultural-design objects, sculptural works, archival works, and other individually produced artistic objects.

WYG works are offered, documented, represented, and sold as artistic, cultural, decorative, archival, and collectible objects.

WYG Hawai‘i does not market, represent, or sell its artworks as drug paraphernalia, smoking devices, or products intended for the consumption, administration, inhalation, or delivery of controlled substances.

The purchaser agrees to possess, display, transport, import, export, and otherwise use any WYG work only in accordance with applicable law.

Any alteration, conversion, misuse, unlawful use, or use inconsistent with the stated purpose and classification of a WYG work is undertaken independently by the purchaser or subsequent possessor and is neither authorized nor endorsed by WYG Hawai‘i LLC.

Nothing in these Terms shall exclude or limit any responsibility or liability that cannot lawfully be excluded or limited.

Legal Compliance

It is the purchaser’s responsibility to determine whether purchasing, possessing, importing, exporting, transporting, or receiving a particular artwork is lawful within the purchaser’s jurisdiction.

Do not place an order if the acquisition, importation, possession, transportation, or delivery of the applicable work would violate law applicable to you.

By completing a purchase, you represent that you are legally permitted to purchase and receive the artwork at the destination provided to WYG Hawai‘i.

International purchasers are responsible for applicable customs requirements, import restrictions, duties, taxes, brokerage charges, and other governmental requirements associated with delivery, except where expressly agreed otherwise in writing.

WYG Hawai‘i LLC reserves the right to refuse or cancel a transaction when fulfillment would reasonably appear to violate applicable law, shipping restrictions, sanctions, governmental requirements, or these Terms.

Payment Fraud

WYG Hawai‘i LLC maintains fraud-prevention measures to protect its customers, artworks, transactions, and business.

Suspected payment fraud, unauthorized transactions, identity misuse, chargeback abuse, or other fraudulent activity may be investigated and reported to payment processors, financial institutions, platform providers, insurers, and appropriate authorities.

WYG Hawai‘i LLC reserves all rights and remedies available under applicable law in connection with fraudulent transactions.

Final Sale Policy

ALL SALES ARE FINAL, except where otherwise expressly agreed by WYG Hawai‘i LLC in writing or where a refund, cancellation, replacement, repair, or other remedy is required by applicable law.

Because WYG artworks may be individually handmade, one-of-one, limited, registered, documented, customized, allocated to a specific collector, or removed from availability upon purchase, WYG Hawai‘i LLC does not generally accept returns or exchanges based upon change of mind, purchaser preference, or buyer’s remorse.

Separate written terms may apply to restoration work, commissions, custom orders, deposits, gallery transactions, distributor transactions, shipping claims, damaged shipments, or other specialized transactions.

Nothing in this Final Sale Policy eliminates any consumer right or remedy that cannot lawfully be waived.

These Terms apply to users of the website, including visitors, purchasers, collectors, clients, galleries, distributors, vendors, service providers, and other persons who access or interact with the Service.

Online Store Terms

Works offered through WYG Hawai‘i LLC may include handmade, one-of-one, limited, individually documented, certified, authenticated, registered, or otherwise artist-produced collectible glass art, as specifically identified in the documentation accompanying each work.

You may not purchase, possess, modify, use, transport, import, export, resell, or otherwise interact with a WYG work for an unlawful or unauthorized purpose.

You may not use the Service in violation of applicable law, including laws concerning intellectual property, fraud, payment processing, privacy, data security, trade, importation, exportation, sanctions, or other applicable legal requirements.

Purchase of a physical WYG artwork transfers ownership of the physical object according to the applicable transaction documents. It does not transfer copyrights, trademarks, design rights, reproduction rights, manufacturing rights, proprietary techniques, trade dress, certification systems, registry systems, photographic rights, or other intellectual-property rights unless expressly transferred through a separate written agreement.

Use of the website or purchase of an artwork does not authorize the purchaser to reproduce, counterfeit, replicate, commercially manufacture, falsely attribute, or create unauthorized editions or copies of any WYG work.

Violation of these Terms may result in suspension or termination of access to WYG services and may subject the responsible party to other rights and remedies available under applicable law.
